Senedd scraps cut-off date for recording historic paths in Wales

Last week, the Senedd in Cardiff passed the Legislation (Procedure, Publication and Repeals) (Wales) Bill, effectively removing the threat of thousands of unrecorded footpaths being lost across Wales.

BMC Access & Conservation Officer for Wales, Tom Carrick, says, "Recent events, such as the blocking of an important connecting route between the village of Cwmparc and the mountain that residents use for their leisure and outdoor recreation, helped draw attention to the poor provision of access and the importance of safeguarding public rights of way which may not be registered on the official map. Thanks to the efforts of local campaigners and the submission of sufficient historical evidence of use, the path is due to be reopened and will be designated as a right of way.

"As BMC staff supported Cwmparc residents, it also became apparent that existing legislation still included a January 2026 deadline for recording historic public rights of way. Although the Welsh Labour Government had long stated it would not act on this provision, the fact that it remained in the legislation posed a risk - especially with elections looming in 2026. A future government could have chosen to enforce the cut-off, potentially putting historically used routes at risk of being lost for good.

"There are an estimated 8,000 miles of unrecorded footpaths across Wales which currently lack legal protection. By repealing the cut-off date, the new Bill ensures that communities have the time they need to research, document, and safeguard these routes, protecting public access to the countryside for generations to come."
